海軍司令部指網路流傳「610港內打雄三」事件涉觸犯陸海空軍刑法20條洩漏軍事機密罪。高雄地檢署昨表示，因國民黨政策會執行長蔡正元也在臉書貼截圖，近日將以證人身分傳他說明，釐清消息來源。颱風來襲，昨海軍已將遭雄三擊中翔利昇號漁船拖回左營軍港停泊。

對此，蔡正元表示不論誰問，答案都是「不知名人士傳訊息告知我，經調查確有其事。」軍方大動作查洩密，蔡正元嗆，蔡政府是惱羞成怒，企圖轉移焦點、粉飾無能。他說，海軍司令部擬以《陸海空軍刑法》20條洩漏軍事機密罪，法辦所謂可能洩密現役軍人，但適法性上有爭議。

法界人士說，蔡不是軍職，職務上也與飛彈無關，因此實務上辦他洩密很牽強，但如將消息透露給蔡正元者具軍人身分，甚至在戰情系統，恐難逃偵辦。

蔡正元接受陸媒專訪曾說，當天不知名人士傳訊給他，查證時因軍方支吾其詞，因此認為非空穴來風，於是在臉書公布。後也上傳「610港內打雄三」截圖，指飛彈誤射很多人目睹。

有關「610港內打雄三」群組對話，雄檢現已找出幾個名字，將釐清是否負保密義務，有無涉洩密。由於全案仍屬他案，加上涉案事實不明，即使找到人，也不見會馬上改列被告、轉為偵案。
